Terms and Conditions of Sale
This website is owned and operated by Kelalan Pty Ltd (ACN 140 513 462) as trustee who will be referred to as “we’, “our’ and “us”.
These terms and conditions govern all orders placed online, by telephone, by email or facsimile. You may place an order to purchase any of our products through our website (via secure server) or by contacting us directly.
When placing an order with us, you are deemed to have read, understood and accepted these terms and conditions. A contract between you and us is not formed though until such time as we have received your order together with full payment thereof.
If you do not understand any of these terms and conditions or would like further explanation or clarification as to their operation and effect, please contact us or obtain your own independent legal advice prior to placing your order.
These terms and conditions and all our dealings with you shall be governed by and construed in accordance with the laws of the state of Queensland and, where applicable, the laws of the Commonwealth of Australia, for the time being in force. You hereby submit to the non-exclusive jurisdiction of courts of or exercising jurisdiction in Queensland and all courts competent to hear appeals therefrom.
These terms and conditions have been prepared for use in Australia under Australian (and more particularly Queensland) laws. We are happy to supply our products outside Queensland however any statutory or common law warranties (whether express or implied) which you may ordinarily enjoy under the law of other States shall not apply to any order placed with us.
We will use our very best endeavours to provide you with superior service and the highest quality products. However, we are not liable for any delay or failure to perform our obligations under these terms and conditions as a consequence of acts of God, civil or military authority, acts of public enemy, war, accidents, fires, explosions, earthquakes, floods, the elements, strikes, labour disputes, shortage of suitable parts, components, materials including ink, chemicals and paper, labour or transportation or any other cause beyond our reasonable control.
Stock
We will endeavour to ensure that we have adequate stock of all products listed for sale on our website unless otherwise specified. On a rare occasion though, due to circumstances out of our control, it is possible that we may run out of stock of a particular product. If this occurs, then we will notify you as soon as possible and give you the option to either:
- place the product on back order;
- cancel your order and receive a full refund or credit; or
- accept one of our other products in substitution to the product you ordered.
Availability of products is subject to change without notice.
Pricing and Payment
The prices for online orders for each of our products are listed on this website. Prices and offers available online may differ on occasion from those found in stores or offered as part of other promotions. Any prices displayed on this website are subject to change without prior notice.
All prices are listed in Australian dollars and all prices displayed are GST inclusive. Prices do not include the cost of delivery and all postage, shipping or airmail is charged in addition to the listed prices. Refer to "Shipping" below for further details.
We accept the following methods of payment:

Full payment of the purchase price together with the cost of delivery must be received as cleared funds prior to goods being dispatched. Time for payment is of the essence.

The formula, composition, design and appearance of all our products and packaging remains our property at all times and must not be copied, imitated, reproduced or distributed without written authority from us. We will continue to enjoy all intellectual property rights with respect to our products and packaging including, but not limited to, any trademarks, patents, trade secrets, copyrights, processes, knowhow or registered designs.
All information and material contained on our website is subject to copyright and we shall at all times remain the owner of all intellectual property rights. The information and material contained on our website must not be reproduced, copied, transferred, distributed or stored without written authority from us.
